Halle Berry Court Drama Over Son Is Her Biggest Heartbreak

From her messy divorce from her first husband, David Justice, to her second husband Eric Benét’s infamous infidelity to her bitter custody battle with ex-boyfriend Gabriel Aubry—Halle Berry’s has had more than her fair share of heartbreak in the public eye. But her latest custody battle with ex-husband Olivier Martinez over their 13-year-old son, Maceo, hits different.

After years of watching her navigate heartbreak in the spotlight, this latest chapter may be one of the most painful to see.

Berry knows all too well what it feels like to have deeply personal moments turned into public talking points. Her 1990s divorce from Justice played out under intense media scrutiny, with the public weighing in on the end of their marriage, why they should’ve never married young, and murmurs of potential domestic abuse. In 2004, the “Monster’s Ball” star gave viewers even more of a personal glimpse into her heartbreak when she tearfully discussed Benét’s infidelity during an infamous interview with Oprah Winfrey and how it affected her.

Years later, her custody battle with Aubry over their daughter, Nahla, became another headline-making ordeal, complete with a highly publicized legal fight over where their daughter would live and an eventual ruling that she’d have to pay him child support. And her negative relationship with her third ex-husband, a.k.a. Martinez, seemed to shape up in a similar fashion, thanks to their years-long divorce proceedings, additional child support being dished out to him, and now, their messy custody battle over Maceo.

As you’ve probably heard by now, Maceo testified before a judge earlier in the week, speaking to his lived experience with his mom and going over the alleged events and circumstances that led them to this moment.

While Berry and Martinez weren’t allowed inside while he was talking, both Page Six and Entertainment Weekly note that the child testified for four hours. When he was done, he reportedly made his way to his father and did not talk to or acknowledge Berry. The Oscar-winning actress’ daughter, Nahla Aubry, is also expected to testify at some point during the process.

On Friday, Page Six also reported that Martinez doubled down on his abuse allegations against Berry during their latest court showdown, despite being confronted with his own previous sworn statement denying any history of domestic violence between them. During cross-examination, Berry’s attorney pressed him on claims that Berry had abused him over the past decade, then presented a September 2024 declaration in which he confirmed there was no history of domestic violence between them—a statement he acknowledged was true when he signed it.

This comes just days after eyewitnesses claim that Martinez “stormed out” of the courtroom and was “cursing” while with his lawyer during a break in the proceedings. However, his lawyer told TMZ and a source later told EXTRA that it was false, a “total misrepresentation,” and that Martinez simply asked to take a bathroom break.

And while Berry’s past relationships have given the public plenty to dissect and been heavy to deal with, this current situation isn’t just another breakup or a former couple trading accusations in the press.

The public has blamed Berry herself for the relational turmoil she’s endured over the years, with certain folks basing their reasoning on her poor discernment when it comes to picking her partners. But what they fail to realize is that even if that’s the case—it still doesn’t excuse her partners for their bad behavior. It also doesn’t mean she’s deserving of a fractured relationship with her son or that she deserves to endure this kind of familial strife.

Whatever mistakes Berry may have made in her romantic life, they do not negate her right to forge and maintain a loving and respectful relationship with her child or vice versa. Nor do they excuse any behavior that could jeopardize that bond.
At the end of the day, no romantic fallout compares to the pain of watching the relationship with your own child become another battleground. And that’s what makes this chapter arguably the most heartbreaking one Berry has had to navigate.

As we’ve been telling you, things between Berry and Martinez blew up in a major way in October after the latter alleged that the Oscar-winning actress physically abused their 13-year-old. While Berry and her legal team called the claims and Martinez’s filing for temporary full custody and a restraining order against her “meritless” and “deliberately misleading”—things only escalated from there.

This was due, in large part, to the accusation from Martinez that Berry “choked” and put her hands on Maceo during a September 2026 incident and his allegations that she had a history of getting “physical” with the child and inflicting “emotional distress.” However, later court documents revealed an unfortunately longstanding, slightly contentious relationship between Berry and Maceo, and by extension, Martinez.

He also claimed that there was photo evidence to prove the altercation took place and that Maceo suffered bruising. But Berry recently pushed back, claiming that the photo shows her standing calmly with her hands in her pockets, several feet away from their son. The Oscar-winning actress also alleged that there were no visible bruises, redness, or injuries to support Martinez’s allegations.

There’s been no word yet on how long the proceedings will last.
