Halle Berry Faces Brutal Blow in Court Days After Instagram Hack as Her Ex-Husband’s Parting Words Strike a Nerve

Halle Berry will remain in family court with her third ex-husband after a judge issued a ruling Thursday in the case involving her son, Maceo.

The Oscar-winning actress has been fighting allegations from Olivier Martinez, who accused Berry of physically abusing their teenage son.

Appearances from both parties in the case have stretched into a second week in the Los Angeles courtroom, where Maceo and Berry’s 18-year-old daughter from a previous relationship, Nahla Aubry, have testified in closed-door sessions.

In the latest ruling, Los Angeles Superior Court judge Shelley Kaufman denied Berry’s request for 50/50 visitation.

Martinez now has primary custody while the case continues, but he had more to say outside the courtroom.

“You can’t have justice without truth,” Martinez told TMZ. “Today, truth has been said, lies have been seen, and justice has been done.”

According to his lawyer, Patrick Baghdaserians, their client is happy he got what he wanted from his victory over Berry.

“This is exactly what he wanted. Day one, he wanted to protect his child. There will be no overnights,” Baghdaserians said on-camera.

Baghdaserians added that the court also ordered Berry to attend therapy with her son and sealed Maceo’s testimony.

“What I wanted is peace for my son. He has to get through a lot. Too much,” Martinez added before walking away from the camera.

Martinez, 60, obtained a temporary restraining order after alleging Berry “attacked” their son on Sept. 26 by jumping on him, grabbing his neck, and choking him.

Their primary joint custody agreement is null and void. According to the Los Angeles Times, Berry now has limited hours with her son to Mondays, Tuesdays, and weekends between 10 a.m. and 8 p.m.

Berry’s attorney, Marina Beck, told Page Six she was pleased the court dissolved the order. Beck said Berry remains focused on her family’s well-being.

“We are extremely pleased that the Court has dissolved the TRO,” Beck told the outlet. “As we move forward, Halle is determined to continue to focus on the well-being and best interests of her family.”

The judge’s decision comes two days after reports about Berry’s hacked Instagram account. A posted message on her Story read, “If kids disrespect their mom, the root cause often traces back to their relationship with their father.”

TMZ reported that a Berry representative told them she’d been hacked.

Many assumed Berry wrote the message herself or someone from her team online. However, she has not posted anything on her Instagram page since Sept. 25, one day before the incident with her son.

Maceo testified for nearly four hours in a closed setting on Oct. 19. His parents, a therapist, a school official, and Berry’s fiancé, Van Hunt, also testified over nine days of the hearing.

Martinez later stormed out of the courtroom and used profanity during the closed-door proceedings, according to reports.

Aubry previously defended her mother in a court declaration. She said she had never seen Berry act aggressively toward her younger brother.

But the custody battle has been anything but peaceful. Martinez secured a temporary protective order on Oct. 1 after accusing Berry of choking their son, allegations the actress has repeatedly denied.

Berry fired back through her attorney, accusing Martinez of repeatedly violating court orders and interfering with their son’s therapy and education.

She also sought sole legal custody, arguing she should have the final say on Maceo’s health, schooling, and welfare while they continued sharing parenting time.

Berry and Martinez married in 2013 and separated in 2015.

After an eight-year battle to finalize their divorce in 2023, they agreed to joint custody of Maceo, with Berry paying Martinez $8,000 monthly in child support.
